MASERU – The appointment of Dr Kananelo Mosito KC, as the President of Court of Appeal of Lesotho, will be affirmed today, Thursday, following his successful appeal against his intended impeachment.

Following last week Friday’s Court of Appeal judgement and order that Justice be immediately sworn in as the President of the Court of Appeal, the office of the High Court’s Registrar on Tuesday issued a memo that Dr. Mosito will be sworn in on Thursday this week.
According to the memo which High Court’s Acting Registrar Advocate Ponts’o Phafoli confirmed, the swearing in ceremony of Dr. Mosito into office as the President of the Court of Appeal of Lesotho would be today, November 1, 2018 at the Royal Palace

Dr. Mosito’s swearing in comes shortly after civil and criminal cases that were levelled against him by four senior lawyers and former Director of Public Prosecutions (DPP) in which he was among others, accused of not being fit and proper to hold office of the country’s apex court were set aside by October 26, 2018 Court of Appeal judgement. According to the chronology of events, Dr. Mosito was first appointed as President of the Court of Appeal of Lesotho by King Letsie III with the advice of the Prime Minister Dr. Thomas Thabane on August 1, 2017.


His appointment was a few days later challenged by some lawyers who filed a case challenging his appointment on among other grounds that Justice Robert Nugent who was acting in that office as the President was not removed legally. A tribunal to investigate whether Dr. Mosito is fit and proper to hold office as President was also established and conducted its investigations after which it wrote a report, its findings and also recommended for Dr. Mosito’s removal from office.


It is evidence before the Court of Appeal that in the mist of the cases against him and tribunal investigating him, Dr. Mosito wrote his resignation letter to the King's office and that the letter reached the office before the tribunal’s report. He was however eventually removed from office but the appeal which he filed at the court of appeal vindicated him and ordered for his restoration into office with effect from August 1, 2017.
