THE High Court will on Tuesday make a decision in an application in which three of the four police officers who are accused of the murder of Police Constable Mokalekale Khetheng want the presiding judge to recuse himself from the case.

In the application filed last week, Mabitle Matona, Mothibeli Mofolo and Haleokoe Taasoana want Justice Charles Hungwe from Zimbabwe to recuse himself from the trial, saying he would be biased against them.

They allege that disconcerting insinuations were made therefore they were afraid they will not get a fair hearing.

The applicants further allege that they have been psychologically harassed and bullied by the prosecutor, Senior Counsel Shaun Abrahams from South Africa.

They also contend that they were comprised when they were compelled to plead in the absence of their lawyer, King’s Counsel Zwelakhe Mda, adding that a prejudicial approach of the judge to the case is of concern to them.
The three are charged along with Senior Superintendent Thabo Tšukulu for the murder of Khetheng in March 2016 in Sebothoane,

Leribe.They also face charges of perjury and defeating ends of justice. LeNA
